How is money checked?
It is difficult to imagine how counterfeit banknotes ended up in reputable banks, because these institutions spend a lot of money to protect themselves from such situations. The money starts its way to the ATM from the bank vault. First, cashiers open the bundles of banknotes, carry out a visual inspection, and count them using a banknote detector, which, among other things, checks the authenticity of the money. Further, money of the same denomination is sealed in special cassettes.
The regulation of the Bank of Russia under number 318 P of 24.04.08 “On the procedure for conducting cash transactions and the rules for storing, transporting and collecting banknotes and coins of the Bank of Russia in credit institutions in the Russian Federation” states that cash for ATMs must go through processing in a credit institution, with the participation of sorting and counting machines, sorting banknotes into suitable and unfit for circulation. These same machines detect counterfeits, if any, with security marks that only a machine can read. There are 4 characters in total, and their mandatory check is spelled out in a regulatory act of the Bank of Russia.
ATM errors
Almost all ATMs scan banknotes for certain protected parts of the banknote. Unfortunately, not all ATMs are equipped with a high-precision scanning device that allows you to identify a banknote.
ATMs check money as usual. However, when a large amount of money is deposited, the allotted seconds are not always enough for checking, to recognize a fake. This explains why the ATM takes counterfeits, and in the case of fraud, it is often about 5,000 bills.
In fact, ATMs are a complex technical device, which, like any technique, tends to break down. In some cases, malfunctions occur, as a result of which the amount of money that is not requested by the client is issued. The reasons for issuing a larger amount than requested by the client may be:
- Software error.
- The technical error.
- Error of the cashier who was loading the money.
If the client is faced with such a situation, it is worth contacting the bank branch, since the automatic system will sooner or later reveal this incident. And having dealt with the situation, the client can be presented with a serious claim.
Remember responsibility
If you have banknotes in your hands, the authenticity of which you doubt, do not try to get rid of them by paying, for example, in a store. Remember, this can lead to criminal liability.
Currency circulation is in the department of the state, and cashiers of shops or employees of public places have no right to seize dubious bills from you. They can only suggest that you wait for the police to draw up an act.
Remain vigilant. If the seller suddenly said that he would not accept a bill, immediately take it away and do not let it be taken anywhere “for verification.” There is a risk that you may be deceived and returned a fake one.
But bank employees can take questionable banknotes from you.
Instead of money – a bookmark
According to statistics, counterfeits from time to time were found in Sberbank and Alfa-Bank. Basically, these were large denomination bills – from 5,000 rubles, which came across to customers at an ATM.
There were also funny situations when one of the Sberbank users withdrew a large amount of money through an ATM, but on one of the banknotes, instead of the usual image of Khabarovsk, he saw the opera house of the city of Odessa! The user waited about 3 months for an official confirmation from the bank that it was in fact a fake. Another client of the Bank of Moscow was handed not a 500 ruble bill, but a bookmark for books, which is very difficult to confuse with the original.
The end of these and similar stories is the same: users were convinced that an ATM can issue counterfeit banknotes, but it is almost impossible to get compensation for losses. All counterfeits, as a rule, were of the highest denomination, since it is unprofitable to counterfeit banknotes of 100 rubles. In addition, the question arises, how did the cashiers and calculating machines not see the fake? Agree, confusing money with bookmarks is really difficult.
How does the terminal detect a fake?
The ATM detects the counterfeit bill using two tools:
- A laser that responds to the size of the banknote. So, for example, if a 100-ruble note inserted into the terminal turned out to be significantly less or more than it should be, the ATM will consider it invalid;
- Ultraviolet light. He reads all those security signs that are present on the banknote: foil thread and engraving of numbers on it, small multi-colored stripes, as if scattered over the banknote, holograms, etc .;
- Scanning for a magnetic field. Each large banknote (1000, 2000 and 5000 rubles), even in the process of creation, acquires its own magnetic tag – it is extremely difficult to counterfeit, therefore it is necessary for mutual settlements involving large amounts. Most ATMs have such a reader, but, unfortunately, not all.
At the same time, the laser and ultraviolet light scan only certain areas of the banknote, which is often used by fraudsters: if you know the location of these zones, you can glue bills of different denominations (for example, 100 and 5000 rubles) and insert into an ATM under the guise of a banknote of the largest size.
The ATM will automatically check the areas where the elements of 5000 rubles are prudently pasted in, and consider it to be the original. As a result, fraudsters can make several such “banknotes” from a single large denomination note.
Purposeful deception?
When wondering how to cheat a Sberbank ATM and withdraw money, it is important to remember about criminal liability, despite numerous videos and black schemes. All of these “visual aids” are fraught with serious consequences.
Among the recorded cases of deliberate deception, the following can be distinguished:
- If you need to change bills, you can put two banknotes with a face value of 5000 rubles into an ATM account. And then withdraw this money in parts. Twice 4,000 rubles each, and then request an amount of 2,000 rubles. Therefore, if an exchange is necessary, you should not contact the cashier, it is enough to spend a few minutes at the ATM and successfully solve your problem of exchanging a large bill into small ones. To solve the problem of the exchange of an ordinary person, this is a real way to get money of a lower denomination. And fraudsters use counterfeit bills, which become real money within a few minutes.
- In some ATMs, until recently, the following scheme worked: it is necessary to use a “left” bank card of Sberbank and a banknote. Having entered the PIN code and without waiting for the end of the operation, the bill is inserted into the still closed bill acceptor. The denomination does not matter in this case. The bill is inserted halfway. Then, you need to click on the “deposit cash” option. The device starts to “think”. According to him, the banknote was simply jammed. After a certain amount of time, an inscription appears about the amount of the claim. Enter and confirm the amount of 5000 rubles. Check and crediting are guaranteed.
- A case was recorded with cutting bills. The fraudster is informed about all the security elements by which each incoming banknote is checked into the bill acceptor. He neatly cut the five-thousandths into two pieces and neatly supplemented them with other small banknotes. Such a system was implemented by a person perfectly familiar with the system of reading recognition elements. The ATM successfully accepted all the money and credited it to the attacker's account.
Get ready to say goodbye to money
The money can be returned if the check shows that it was real. Then you will either be given money in your hands, or they will be credited to your account.
If your fears are nevertheless confirmed and the banknotes turn out to be fake, then they will either be destroyed or returned to you with a stamp of invalidity. The law prohibits exchanging them for real ones.
You can, of course, try to recover the damage from the one from whom you received the fake. But this can only be done through the courts. And it is often difficult to remember exactly how the fake got into the wallet – in the “24 hours” shop near the house, at a gas station, in a small cafe, and so on.
Ways to cheat a Qiwi ATM
Recently, many people have been using Qiwi wallets. This means that they attract the interests of fraudsters who ask themselves how to cheat a Qiwi ATM. The scheme for deceiving intruders has the following algorithm:
- Terminals are being looked for, which are located in uninhabited places or where there is the lowest traffic of people.
- A special script is driven in (on the terminal keyboard). This is a special program that aims to orient the transaction itself.
- After its installation, all payments will be made not according to their purpose, but will be redirected according to the installed program.
Any user who suspects nothing will simply send their money to the scammer's wallet. To protect yourself, you must:
- Try not to use terminals in deserted places.
- Pay attention immediately to the external indicators of the terminal. The presence of any kind of damage should definitely alert.
- Try to find out the name of the contractor that maintains this terminal and inform.
Mass stuffing of 5000 bills “joke bank tickets”
Old working terminals have always been the subject of attack by fraudsters who have found ways to defraud the ATM. A case of a massive injection of counterfeit five thousandth bills was recorded. This happened due to the lack of a modern recognition system in old devices. This factor was used by scammers, who turned out a serious financial fraud.
In St. Petersburg, a case was recorded when malefactors loaded 5000 bills from a joke bank into a bill acceptor. All banknotes were treated with a special solution. The total amount of damage was five million rubles. The scammers deposited money on several bank cards and managed to cash them out before the security service discovered the counterfeits.
If a counterfeit bill was found during the checkout in a store or bank?
In case of a counterfeit note, both the seller and the bank employee must have a job description, according to which the actions of the cashier or bank employee must take place, and this instruction must be based on the instructions of the Central Bank of the Russian Federation and the Ministry of Internal Affairs.
Of course, these instructions state that police officers must be called to the scene. You should not panic, keep calm, if you are not involved in the sale of counterfeit money, then there is nothing to attract you for, and the fact that you came across a counterfeit bill is not your fault, no one is immune from this.
At least until the police officers arrive, you should not touch the bill with your hands and give it to someone else for inspection, let the police officers come and take all the necessary actions, and you should not touch the bill because the fingerprints of the guilty persons could remain on it, which can be calculated …
When you testify, then tell everything as it is that the bill fell into your hands by accident, you did not know that it was counterfeit, try to remember where it was handed over to you. Once again, I repeat that if you really do not participate in the sale of counterfeit banknotes, then you have nothing to fear, tell us how it all happened.
If you received a bill and suspect that it is fake, then, as I said, there is no need to try to sell it by buying goods or paying for services, you have the option to conduct an examination in the bank and in the process of examination it will be found out whether the bill is fake, about which an expert opinion is issued …
In general, in such a situation there is nothing terrible or outrageous, even if you paid with such a bill and a fake was revealed during the calculations, you will simply waste time on the proceedings and everything, in general, everything will end happily, the only negative you will lose time and money.
Counterfeit detected at retail locations
So, let's say you came to the store, collected a mountain of purchases and when paying for goods at the checkout, the cashier declares that your five-thousandth is a counterfeit bill. Of course, this statement will shock you. What should the cashier do next? What should you do?
Our legislation nowhere regulates what a service worker should do if a client pays with a counterfeit bill. It is clear that no one will accept it as payment for a product or service, but what to do next?
It is generally accepted that the bill should be withdrawn, the police should be called and an attempt should be made to keep the client until she arrives. In practice, few people use this scheme.
Basically, the policy of the companies is as follows: to return the bill back to the client, recognizing it as dubious, but still not fake, asking to replace it with another one. More often than not, no one wants to contact our valiant police, wasting time and nerves on the proceedings.
In fact, the cashier, having found a fake, must call the police, because in this case he is faced with an offense. But he does not have the right to withdraw the bill, tear it, since only the bank can reliably determine the counterfeit banknote or not. Store employees also have no right to keep the client. They can only ask the police to wait for further investigation.
If the cashier or store security calls the police, stay calm. Demand that your banknote be returned to you, try to rewrite the banknote number. If the cashier leaves somewhere with your bill, accuse the cashier of the substitution, indicate this in the police report.
How much will be given to the manufacturer of counterfeit banknotes, and how much – to their distributor?
According to the Criminal Code, all criminals who in any way facilitate the entry of counterfeit funds into money circulation are equally liable. This means that each of the accomplices in the crime will be punished under Art. 186 of the Criminal Code.
Why is there so much counterfeit money from Russia? Due to the economic crisis, people's confidence in banking systems is falling. Citizens try to keep cash in their hands, and this increases the likelihood of receiving “bad” money.
If a police squad has been called, I recommend proceeding as follows:
- You must keep the counterfeit banknote until the police arrive. It is possible that the seller or the cashier made a mistake, and in fact, the bill is not fake. Only a special examination can establish this fact.
- Remain calm and wait for the arrival of the police officers. Of course, there is no desire to meet with them, since there is a possibility that they may bring charges of counterfeiting money against you. But if you leave, it can be perceived as a desire to escape from the scene of the identified crime and will be directed against you.
- While you are waiting for the police, try to remember under what circumstances you got this bill. It can be difficult, but you should have some plausible version, even without specifying specific details. Your confident explanations about the fake can help police officers understand the case and deflect suspicion from you.
- If, in the course of communication with the police, you realize that you are being detained and planned to be interrogated as a suspect, immediately ask for a criminal lawyer. In this case, it is better not to trust the lawyer proposed by the police, but to have the contacts of an independent lawyer with you.
IMPORTANT! If you are lucky and the person who identified you with a counterfeit bill does not report it to the police, in no case try to use it again. In this case, you will commit a serious crime under Article 186 of the Criminal Code of the Russian Federation – the sale of knowingly counterfeit money.
You can voluntarily hand over this bill to the police, having thought in advance what you will explain on the circumstances of its appearance in you, or simply destroy it, for example, burn it.
You cannot continue to keep it with yourself, since criminal liability has also been established for the storage of counterfeit money.
How to recognize a fake yourself
According to the Bank of Russia, a 5,000-ruble note is most often counterfeited by fraudsters. In the second quarter of 2018, the regulator detected almost 7,000 such fakes. The second most popular among fraudsters is the 1,000-ruble banknote – the regulator discovered about 2,300 such counterfeits in the second quarter.
According to experts interviewed by Forbes, there are two types of counterfeit banknotes: some for people, others for ATMs. “Fakes that are made for people, as a rule, are not recognized by machines, scammers make them beautiful and similar to the original only externally. In the second case, fraudsters fake only machine readable features.
The fact is that the ATM, when identifying a bill, evaluates such parameters as dimensions, down to nanometers, the location and material of the “diving” security lines, the density of the paper, the presence of luminescent and magnetic elements.
“As a result, because of the” color blindness “of most modern ATMs, counterfeit banknotes intended for them are made black and white, and some of them are completely deprived of a picture – only the elements necessary to recognize a digitized banknote with a digital cast are copied,” says Zharsky … That is, a person can easily distinguish such banknotes.
Such banknotes can only be identified by experts or cashiers who know the distinctive features of the types of printing used in the production of banknotes, security features of banknotes against counterfeiting, as well as methods of imitation of these elements.
So it will not be possible to recognize a high-quality fake, therefore, in order to protect yourself in case of deception, you should follow a few simple rules. Namely: always request a bank check when receiving funds from an ATM and keep it at home, do not use a dubious type of ATM that has keyboard lining, dents or other signs of inconsistency.
How much do they give for counterfeiting money in Russia?
By the sanction of Art. 186 of the Criminal Code of the Russian Federation provides for punishment for forging documents both in the form of correctional labor and in the form of imprisonment.
The specific type of punishment depends on the severity of the crime committed, the number of persons involved in organizing the forgery of documents, as well as whether the suspect has any diseases, dependent children, etc.
How to maximally protect yourself from receiving counterfeit money
- Give preference to cashless payments.
- Exchange currency at banks, not small exchange offices.
- Check the received bills on the spot. If you have a special device (at the checkout or at your place), check the cash with it.
- Do not exchange small bills for larger ones in markets, small outlets or with individuals.
In what situations can you get your money back?
If the bill was real. Then you will be notified by the bank or the police and you can get your funds back.
If you find that the bill is counterfeit, you can try to obtain damages from the person who gave you the bill. For example, from the store in which you were given change, or from the bank, in the ATM of which this bill was found. But compensation can be achieved only at the stage of the trial.
Does the police have the right to detain a person who paid with counterfeit money, not knowing that it is counterfeit?
If it so happens that the cashier, accepting money from you for the goods, discovers that you gave him counterfeit banknotes, suspects you of counterfeiting and calls the police, then the internal affairs officers have the right to come and detain you.
If you didn't know that the money was counterfeit, then you will have to prove it to the police officers. Only after revealing that you had no criminal intent, you will be cleared of suspicion of committing a crime.
If a person makes banknotes or securities that have already been withdrawn from circulation, for example, Soviet money, coins of the old minting, that is, those monetary units that are only collectible value, then the corpus delicti under Art. 186 of the Criminal Code of the Russian Federation will not be.
However, if he makes old-style banknotes for the purpose of selling for a considerable amount, giving counterfeit banknotes as real ones, then his actions fall under Art. 169 of the Criminal Code of the Russian Federation “Fraud”.
Counterfeit bills got into the ATM from the payer
Each device that can accept money is equipped with a built-in bill validator, but counterfeiters have already managed to deceive them – such incidents are recorded regularly, and in 2013, many credit institutions even decided to disable the acceptance of five thousandth banknotes in their ATMs. But scammers almost always target obsolete ATM models, and devices with a closed cash circulation are among the newest and most advanced.
One way or another, these ATMs are not very common yet. So, Alfa-Bank has about 600 such devices (out of 3600). But Sberbank, with the devices of which, according to users of banking forums, most of these incidents occur, do not have closed-loop ATMs at all.
What to do with a counterfeit banknote received at an ATM
Unfortunately, we have nothing to recommend to victims of fakes lurking in ATMs. Even if you immediately identify a fake among the cash received, it will be almost impossible to prove that it was the ATM that gave it to you. The only thing that you definitely should not do is try to pay off with it somewhere, since you in this case fall under Article 186 of the Criminal Code of the Russian Federation on counterfeiting. Carry this bill to any bank: it will be taken from you and a corresponding certificate will be issued.
Contacting the bank
If you have doubts about the authenticity of a bill, you need to send it for examination. To do this, bring it to a banking institution. Only his employee has the right to accept and withdraw counterfeit cash from circulation.
There are several categories to which banknotes can be classified after verification:
- dubious;
- insolvent;
- with signs of forgery.
If during the check it turns out that the bill is insolvent, it will be stamped “Exchange refused”. It itself is returned to the client. You cannot pay with such money.
If banknotes are suspicious or have signs of counterfeiting, they are treated differently. The bank employee will withdraw them. Will draw up an act and a certificate, which contains the following information:
- date of acceptance of cash for examination;
- Full name of the client;
- passport number and series, when and by whom it was issued.
A separate block in the form contains a table, which indicates the denomination of the banknote, which is accepted for examination, its series and number, the year of issue, as well as additional details. At the bottom of the form there are fields for the signature of the official accepting the bills.
The certificate is made up in two copies. One remains with the bank employee, the second is handed over to the client.
In addition to the certificate, the cashier must accept the bill on the balance. To do this, he draws up a memorial off-balance sheet order. The first copy is filed in the documents of the day along with a certificate, the second is handed over to the applicant. After that, the money is sent for verification. It lasts for 5 working days. The client will then be notified of the results. If the bill turns out to be counterfeit, it will be removed from circulation and destroyed. It is prohibited to exchange it for genuine cash by the legislation of the Russian Federation.
It should be remembered that not all banking institutions provide the service of checking the authenticity of banknotes for free. For some, it is paid. This must be clarified before submitting a bill for verification.
Reporting to the police
This is not to say that this is the best option. This is due to the fact that the investigation may drag on for months. But still, it's better to protect yourself.
Before contacting you, you need to remember how the fake got into your hands. Perhaps the seller gave change in a store or market. Or maybe someone gave it to you, repaying the debt. All these nuances need to be described in detail, since the questions will be asked during interrogation.
You need to answer honestly. Remember the criminal liability for the sale and distribution of counterfeit banknotes.
Criminal proceedings will be opened regarding the detection of counterfeit cash. Investigation and special examinations will be carried out. All procedures are not so fast. The investigation must make sure that you are not a criminal.
If the bill is found to be fake, it will be sent for destruction. Nobody will compensate it. This is prohibited by law. You can recover damages or demand compensation from the person who gave you the fake. True, this can only be done in a judicial proceeding. And as practice has shown, it is quite difficult to prove the fact of transferring a counterfeit bill. As a rule, the applicant does not remember exactly all the nuances of receiving a fake.
Who is to blame and what to do if you receive counterfeit money?
It turns out that replacing a banknote with a fake one is a fraud of a bank employee, that is, a cashier. Vice-presidents and directors of payment services of banks agree that there is a human factor, and an employee of any bank can commit illegal actions. But, nevertheless, in comparison with customer transactions, these cases cannot even be included in the statistics, since there are too few of them. Rather, it is a statistical error.
The work of the cashier is monitored and verified, and even if we assume that the fraudulent scheme works, it is easy to verify.
If the bank's clients claim that they have received counterfeit banknotes from ATMs, they have the right to contact the bank branch and draw up a claim, where they need to indicate the date of receipt of the money and the US number. On the claim, control checks will be carried out, namely: reviewing the process of recounting cassettes to identify worn and cash-friendly banknotes. In addition, a thorough investigation is carried out to establish the details of the event, identify possible risks, culprits, and the reasons for the incident.
If the situation with the client is transparent, then there is a chance for a positive outcome for him.
So, the step-by-step instructions for detecting a fake are as follows:
1 Without leaving the ATM, call the bank guard, who will fix the issuance of a counterfeit bill and coordinate further actions. Write down the ATM number.
2 Contact the bank immediately. Make a written claim in duplicate, in which do not forget to indicate the date and time of the incident, the US number (self-service device, ATM, in other words), and also demand compensation for damages. Make sure that the bank employee signs both copies. Ask to keep the CCTV recordings – some banks only store the recordings for 48 hours, and then it will be more difficult to prove the fact of receiving a fake.
3 On the basis of your request, the bank must carry out a check, this is a long process, in which many structural divisions of the organization are involved. In the course of the investigation, details will be established, possible culprits will be identified, and the risks will be assessed.
5 You can receive compensation in the amount of the full value of the bill, but, unfortunately, this outcome is extremely rare. If the bank refuses to meet you halfway, write a statement to the police on the same day. If the case goes to court, this will be additional proof of your case.
Outcome
Can an ATM dispense a counterfeit bill? The answer is yes, but it is extremely difficult to prove that a bank client really fell victim to cybercriminals. In any case, never try to pay with a counterfeit, as you may be criminally liable under Article 186 (counterfeiting and selling counterfeit money).
